Lambda Biologics Terms of Service

General Provisions

Purpose

This agreement aims to stipulate the terms and conditions of use, procedures, rights, obligations, responsibilities between the users and the site, and other necessary matters regarding all services (hereinafter referred to as “Service”) provided by the Lambda Biologics operated website (hereinafter referred to as “the Site”).

Effectiveness and Modification of the Terms

Detail 1: The Site provides services to users on the condition that the users agree to the contents of these terms, and the provision of services by the Site and the use of services by the users shall primarily be governed by these terms.

Detail 2: The Site may modify these terms without prior notice, and the modified terms will be announced on the Site for users to verify directly. If a user does not agree to the modified terms, they may cancel their membership registration (withdraw from membership). Continued use of the service will be considered as implicit consent to the changes in the terms. The modified terms will come into effect immediately upon announcement.

Rules Beyond the Terms

As part of providing the website, we process personal data about you as a user for legally defined purposes in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG), as well as all other applicable laws for the protection of personal data.

Provision and Use of Services

Establishment of Use Agreement

Detail 1: The use agreement is established when the user completes the subscription by filling out the application form for the use agreement provided online by this site.

Detail 2: This site may cancel the subscription in the following cases:

  1. When the application was made using someone else’s name.
  2. When the contents of the application form for the use agreement are falsely stated or applied.
  3. When acts such as disturbing another person’s use of this site’s services or stealing their information are committed.
  4. When using this site to engage in activities prohibited by laws and the terms and conditions of this agreement.

Consent to the Use of Member Information

  • Improving our products & services (including this website)
  • Possible correspondence with you
  • Establishing, exercising, or defending our legal rights

Protection and Storage of Personal Data : Protecting your privacy is important to us. We ensure that appropriate technical and organizational measures are in place to always protect your data from unauthorized access, unlawful processing, as well as accidental loss, damage, modification, or disclosure. Data is stored as long as necessary to fulfill the aforementioned purposes or as required by applicable laws. Correspondence-related data is deleted no later than 6 months after your inquiry has been answered unless further communication is needed. Cookie-related data is deleted (as specified in our cookie policy) after the expiry date.

Security of Member Information

Detail 1: From the moment an applicant completes the registration process for this site’s services, the member is responsible for maintaining the confidentiality of the information entered, and all consequences arising from providing their ID and password to others are the responsibility of the member.

Detail 2: All responsibilities for the management of the ID and password lie with the member, and if a member discovers that their ID or password has been used unlawfully, they must immediately report it to this site. All responsibilities for not reporting lie with the member.

Service Hours

Detail 1: The service hours are in principle 24 hours a day, 365 days a year, unless there are special disruptions due to business or technical issues of this site.

Detail 2: The service hours mentioned in the first clause are exceptions for the days or times designated by this site due to the need for regular maintenance or unexpected events and accidents.

Service Modification and Termination

Detail 1: The site is not responsible for any damages incurred by users from the materials obtained through the service, nor does it take responsibility for the reliability, accuracy, etc., of the information, materials, and facts posted by members on this service.

Detail 2: The site is not liable for any damages incurred by subscribers in relation to the use of the service that are due to the intentional or negligent actions of the subscribers.

Detail 3: Members wishing to withdraw from the site can terminate their membership by following the withdrawal procedure after logging into the site.

Provision of Information and Posting of Promotional Materials

Detail 1: The site may provide members with various information by posting it on the service as part of its operation.

Detail 2: The site may post promotional materials that are deemed appropriate for the service or have potential utility.

Duties and Responsibilities

Duties

Detail 1: The site shall not engage in activities prohibited by laws and regulations or contrary to public morals and customs and has a duty to strive to provide services continuously and stably.

Detail 2: The site shall not disclose or distribute the personal information of members to others without their consent. However, this does not apply when there is a request from national agencies, etc., according to telecommunications-related laws and other relevant laws.

Detail 3: The site must have a security system to protect users’ personal information (including credit information) so that users can safely use the site’s services.

Detail 4: The site is not responsible for service disruptions caused by the user’s fault.

Your Rights

Under certain conditions defined by data protection law, you have the following rights:

In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to complain, the origin of your data, if not collected from us, and the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;

Detail 2: Request the immediate correction of inaccurate or incomplete personal data stored by us in accordance with Art. 16 GDPR;

Detail 3: Request the erasure of your personal data stored by us in accordance with Art. 17 GDPR, unless the processing is necessary for the exercise of the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;

Detail 4: Request the restriction of the processing of your personal data in accordance with Art. 18 GDPR if the accuracy of the data is contested by you, the processing is unlawful, but you refuse to have it erased and we no longer need the data, but you need it for the establishment, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 GDPR;

Detail 5: To receive your personal data that you have provided to us in a structured, common and machine-readable format and to request the transmission to another controller in accordance with Art. 20 GDPR;

Detail 6: To revoke your consent once given to us at any time in accordance with Art. 7(3) GDPR. This has the consequence that we may no longer continue the data processing based on this consent for the future and

Detail 7: To complain to a supervisory authority in accordance with Art. 77 GDPR. You can contact the supervisory authority – State Commissioner for Data Protection – of your usual place of residence or workplace or our company headquarters for this purpose.

Miscellaneous

Ownership of the Site

Detail 1: The intellectual property rights and other rights related to the services provided by this site, including necessary software, images, marks, logos, designs, service names, information, and trademarks, are owned by this site.

Detail 2: Users are not allowed to modify, rent, loan, sell, distribute, produce, transfer, re-license, set security interests, or commercially use all or part of the aforementioned properties without explicit approval from this site, nor can they permit a third party to do so.

Prohibition of Transfer

Members cannot transfer or gift their right to use the service or any other status under the service agreement to another person, nor can they provide it as collateral.

Compensation for Damages

The site is not liable for any damages incurred by members in relation to the services provided for free, except for criminal acts intentionally committed by the site.
